    Dear all

    Did you know that there is a system in our constitution, as per the 1969 act, in section "49-O" that a person can go to the polling booth, confirm his identity, get his finger marked and convey the presiding election officer that he doesn't want to vote anyone!

    Yes such a feature is available, but obviously these seemingly notorious leaders have never disclosed it. This is called "49-O".

    Why should you go and say "I VOTE NOBODY"... Because, in a ward, if a candidate wins, say by 123 votes, and that particular ward has received "49-O" votes more than 123, then that polling will be cancelled and will have to be re-polled .

    Not only that, but the candidature of the contestants will be removed and they cannot contest the re-polling, since people had already expressed their decision on them .

    This would bring fear into parties and hence look for genuine candidates for their parties for election. This would change the way, of our whole political system... It is seemingly surprising why the election commission has not revealed such a feature to the public....

    Please spread this news to as many as you know...... Seems to be a wonderful weapon against corrupt parties in India... Show your power,expressing your desire not to vote for anybody, is even more powerful than voting... So don't miss your chance. So either vote, or vote not to vote (vote 49-O) and pass this info on...

    "Please Convey this message to as many as possible, so that we, the people of India, can really use this power to save our nation". Use your voting right for a better INDIA.

    Exactly true,
    We need education on election process and candidates elections and nominations.
    Today every politician thinks all the statutes are for his own gain and not the otherway.
    They should realise that they are working for the people and everything they use is people's money.
    We have evry right. Why should we be at the mercy of these selfish politicians.
    Great job,

    Best of luck to every Indian citizen. We need education of facts and not a culture where votes are being bought at the cost of Rs 50 and a biryani packet.

    Yes I come to know about it this time when we had state elections in rajasthan. But the no of voters saying we dont like any candidates must be more than who viote. & I find it difficult that suh ano would be acieved with all illetracy ,lakke of intrest in votin by educated people & all. but yes we shoud try to make achange by spreading this masage.

    What an eye-opening info! Thank you for posting such an important info about our constitutional rights. I've forwarded it to all my contacts. I hope many would do the same and those who are eligible to vote during the coming elections, hopefully should vote for the right candidate or not vote at all!

    The ARTICLE 49-O(not section) is a part of THE CONDUCT OF ELECTION RULES, 1961.
    According to this Article, you CAN refuse to vote for any of the contestants. The rest of the details - 123 people stating 49-O means repolling and the candidates not being able to contest the repolling is NOT TRUE.

    *EDIT* - I believe there is a hoax in circulation about a constitutional section 49-O enabling repolling. Apparently the Indian constitution DOES NOT have a section 49-O.

    49-O. Elector deciding not to vote.-If an elector, after his
    electoral roll number has been duly entered in the register of voters
    in Form-17A and has put his signature or thumb impression thereon as
    required under sub-rule (1) of rule 49L, decided not to record his
    vote, a remark to this effect shall be made against the said entry in
    Form 17A by the presiding officer and the signature or thumb
    impression of the elector shall be obtained against such remark.

    Even I happened to dig in a little deeper on the info and found out that people need to actually verify it in detail before exercising the option of selecting 49-O.

    So,what is it now?
    Is this choice 49-0 still valid in our constitution.
    If so,the best way to make people aware is by passing this msg on to as many people as possible.
    Kindly clear this doubt for me as early as possible.

    Yes, I too had the same question in mind. Laks and Richa, could you please provide the exact information or rules (ACT ) that states, 'What could be done, to show the "no-hope " or "non-faith" on the contestants of elections?

    This 49-0 email that has been doing the rounds is fictional to a large extent.....
    <TABLE cellSpacing=0 cellPadding=0 border=0><TD vAlign=top>Here is the text of the rule 49-O of the conduct of election rules 1961:

    "49-O. Elector deciding not to vote.-If an elector, after his

    electoral roll number has been duly entered in the register of voters

    required under sub-rule (1) of rule 49L, decided not to record his

    vote, a remark to this effect shall be made against the said entry in

    Form 17A by the presiding officer and the signature or thumb

    impression of the elector shall be obtained against such remark."


    Rule 49-O falls under the Chapter II of Part IV of the Rules which was introduced in 1992 and deals only with voting by electronic voting machines or EVMs. The remark referred to here is an offline entry by the presiding offer (accompanied by the voter’s signature) to record the fact that a vote was not electronically recorded even though the voter had registered in the register of voters. This would allow reconciliation of mismatches arising from a situation where you have lesser votes polled in the machines than the names entered and signed in the register of voters. There is no provision for polling to be cancelled based on the number of 49-O votes.

    So our last straw of hope has also gone..................
    We cannot do anything until a few policies in our constitution is changed.
    Any contestant if has a criminal record in the past,should not be allowed to stand for any election in both the houses of the parliament.
    Is this what is happening right now?
    All they do is amass wealth for themselves & their kith and kin.
    The manifestoes will take a backseat once these people are elected.
    Who is bothered about the ideals?:)
