Supreme Court Says - Hindu Son Can Divorce Wife If She Tries To Separate Him From Aged Parents

this is bound to happen when we have the lawyers predominantly in political fronts - that is the reason judgments are also favoring a side and never fair/just.

also the lawyers having argued successfully for defending their clients whether right or wrong - having made a living out of that money - are the ones chosen as judges.

how can we expect these lawyers to give fair judgments on assuming judges role???

 

Leave alone care in old age, parents of daughters dont even get respect and acknowledgement for fulfilling their parental responsibilities. It is as if, if you have daughter then you are not a parent at all.
Then we wonder why people want to have son only. kya kasoor hai un bechare garib ya middle class logo ko , jo sochate hai ki beta ho to accha hai.

 

In this judgment, judges also gave the impression that woman needs to have a strong reasons for demanding nuclear family, it cant be her choice without any reason, as nuclear family is western concept and in india people dont relate with it.
Then women in India belongs to west?? because most of them want nuclear family.

 

What is the need to combine sons financial and other taking care of parents (or daughters responsibility ) responsibility with joint family system.

The son can take care even by living in a separate family. If finances are not enough to have two separate families , then how to solve this problem ? Even small home can be separated and can have separate kitchens by having upstairs setup.

 

Strong reason to get out of nuclear family system? Is mental cruelty not strong enough? I know a lot of people who go through that.How do they prove that? Also the judgement talks about moral responsibility of the son to support parents because they took too much pain to bring up the son. Isn't it the case with daughters too? Do they not have responsibility? If they have is it ok for SC to bring girl's parents to joint family system too?

 

how could daughters have the responsibility of parents, when judge had already said that after marriage woman goes to man's family , hence becomes the part of his family. and it is our age old custom and pious duty of son to take care of his parents....
although as par elder maintenance law if daughter is working and her parents are dependent on her than they can rightfully ask for maintenance from her.

 

There was a recent judgement by Supreme Court that daughters are equally responsible as sons for their parents.

What is know is that parents can ask for money from daughter, if she is working....in this case also daughter is working.
although the decision which we are discussing in this thread also says that woman can not sought for separation from inlaws family for the sole intention of enjoying husband's income alone , especially when parents are poor...
but their reasoning and cultural gyaan was unfair to woman....
