Simple solution Kamalji, the property must be sold off and the proceeds divided equally between the daughter and son of the deceased/ Fixed deposit accounts can be opened in their names and the proceeds deposited there.

    dear kamalji,
even if the dil remarries,it isn't a big issue.as a human being she also needs support.as the property was in the name of father,it should go to his children.if father was no more, then do the children not belong to the family?.that's why i mentioned about the guardian.

    Dea r Balaji,

i guess the eaughter has given her permission to mother to give it to the dIL, and till the MIL is alive she is the boss, all remains in her hands.

    Dear Arthi,

The flat belonged to the MIL, that is the mother of the deceased. The daughter too retains her right to the property, as it is parential property. But i guess the daughter agreed, and the mother has willed it to her dDIL

    Regards

Son's death should not change anything. If such a thing does, all love, acceptance of son's (or daughter's) family is a complete hoax. If that becomes the accepted norm, all MILs and FILs should get kicked out of the homes by the surviving spouses.

the MIL did actually a mistake by giving a will on DIL alone. Now in case if the MIL dies(god forbid) soon and if DIL again marries... have children with second husband, it will become common property . best is that property should be on the name of the grand children with DIL as natural guardian for the ancestral property inherited by kids from father side.

that will be the best solution.

    Dear Steve.

Why kicked out, they were staying in a rented flat in the middle east, and the flat that the mil owns is in mumbai, the mil can kick out anyone she wants. the dIL has no property.
