Property Belongs To Whom?

    That is why it is necessary to make a will.The house was in the name of the father.He should have made a will that after him ,the house will belong to his wife...or atleast will remain in her name till her death......or atleast should have added her name to the property.

    I thought it is obvious that wife gets all rights on her H property after his death. May be only if kids are small that is the case. (I know that if his mother is alive she also gets a share).

    Problem is we Indians don't even want to discuss death and all related things with it.

    I think the best solution is to let the mother talk to all her children.She should live in the house as long as she is alive .Any alterations done by the sister will not effect the share of the children.
    After her ,the house can be divided into four and every one gets their share. The mother's share goes to the son as payment for the house.All three will contribute towards the medical reimbursement of expenses from their share...and this will be given to the sister who is taking care of the mother.

    The sister gets to stay rent free in the house and she gets to earn money by renting her present house.

    This way the mother gets to live in her house with dignity.
    She makes sure there is minimum bad blood between children in future.
    If she does this...there is a chance that the children will continue to have a relationship with each other at least till she is alive.

    No....not if there is no will.
    If there is no will...the property/assets get divided between ,wife and children...with everyone getting one share.

    Similarly if the son dies without a will...his property/assets gets divided between his mother,wife and children equally,with each one getting one share.

    If the wife was the co owner of the property...then her half would be hers ...the other half(dead husband's) half gets divided into his legal heirs...i.e. his wife and children.

    @KashmirFlower (for educational purpose:))
    Our properties are on joint names.We both have separate wills that state...in case of my death ,my share of the property also goes to my spouse.
    In case of death of both...the property gets divided between our children.,A and B.

    Sorry for the digression op.....

    One of my daughter has a voters card now and the other will have one next year.
    We have informed them about what needs to be done in case something happens.
    Hopefully thy will not need guardians.

    We have only made our will now.Like most people in India...we also did not do anything about it till now. Hate to think...what if something had happened.

    This thread is a lesson for everyone.
    I hope people get inspired to write wills after reading the thread.
    It is so apt that this is in the relationship forum .....money and property are the biggest relationship changer.
