Buying Land On Mil's Name ?

    Buy the land in your name and your husband's name. No other party need to be involved. This is your money and even if you think buying in other person's name wont pose any problems, it will come up. If you buy in your mom's name and your husband doesnt like it, that will cause issues in your marriage. Same the other way, if you buy the land in your IL's name, as you don't trust it, this is a potential cause for problems in marriage. If you were not able to buy in your name, keep the money to yourself. There will always be other lands and investments. When you don't have money no one will help you and every one will point fingers it is because you made a bad judgement.

    Register in either your Husband's name or Jointly in both your names.
    Please tell in-laws this would be better arrangement, since registration would need to be transferred in the future... creating unnecessary expenses. Also with the whole demonetization regulations... I am told that the money source needs to be documented, and you are sending it from your account. It is easier for tax purposes as well.

    Do Not discuss SIL... who will the land go to... etc.
    Make it a matter-of-fact-logical choice
    Also make sure the that POA is very specific to buy the property and not a general POA. This is considered a good practice in general to prevent mis use of the document by any 3rd party that comes across the document.

    You will have to get the Power of Attorney document certified by the Indian consulate near your residence in USA.Two copies of the Power of Attorney document with photographs affixed on each copy, near the place of your signature at the end of the document is normally required. There is also a fee charged by the Indian Consulate of US$20. Call the nearest Consulate office for more information and timings

    There is an option to get it registered on your or hubby’s name without your physical presence and with the required paperwork.
