    Hi shoba

    Am in H4, so dont have SSN. When I tried to file the returns online for my husband, it was asking for the status - single, married & filing jointly, married & filing separately etc... which status i have to select ? bcoz if i select married & filing jointly it is asking for my SSN which i dont have !!! Also my husband is here at US only for the sat 5.5 months i.e. 16th June'07...pl clarify....

    and can u suggest the online site to file the returns ?

    Subha - since you are married, you should be filing as "married filing joint" return. You should try to get a Taxpayer Identification Number - ITIN - this is in place of a SSN. See thread below - there was a discussion about how to get ITIN.

    Hi Shobana

    Thank you soo much for the help...one more clarification....

    I downloaded the W-7 form and have filled the form. Its mentioned in the form that we should submit the form along with the tax return. Hope am exempted from filing tax return as am in H4.

    But in order to prove that am exempt from filing tax return in US...can you please let me know what documents do I need to submit along with W-7 ? Shall I submit the form directly to any IRS office location ?

    Or shall we submit the form W-7 while fiing tax returns for my husband ? Pl clarify....

    I am not sure I follow what you mean by " hope am exempted from filing tax return as am in H4". You are not filing a tax return on your own since you have no income. Your husband has income and since you are married, you are filing "married filing joint" return and since you do not have an SSN, you are applying for the ITIN. You have to send notarized copies of item 6d of form W-7 which I presume will be your passport. The instructions to W-7 state that you do not have to submit originals, but notarized copies are ok. So, I would suggest you take copies of all pages of your pages, get them notarized at your local bank where you have an account (they will do it for free when you have an account) and attach all this to your tax return. Since you have to attach these documents, I dont think you can e-file your return - you will have to mail your return.

    yeah! u r correct, i misunderstood that word 'exempt'...

    Is my husband also have to submit W-9 form along with his returns (and also my ITIN form W-7) to get his ITIN no. ?

    I dont have any bank account here...do the bank notarise d xerox copy of my passport (incl. the blank pages), since my husband is having an account ?

    Or is my State Id replace the Passport ?

    I wud be gr8ful if u cud help me in this regard...:bowdown:bowdown:bowdown

    Great thread Shobana....! Usually we file manually and use standard deductions. Will get back later with questions. We usually keep the bills related to the flexible spending account as well.

    Hi Subha - does your husband not have a SSN? Why do you need the W-9? Your husband must be having a bank account, right? Get it notarized there - dont just send a xerox copy- that will not be acceptable to them.

    Dear Shobana,

    My W-7 got rejected saying that I have not signed the Tax returns form 1040....The letter says that

    "W-7 has been rejected for the following reason: The US federal tax return you submitted with your FormW-7, Application for IRS Individual Taxpayer Identification No. was not properly signed. Signatures must be original and located beneath the jurat (Perjury statement). If the return filing status is Married filing jointly, both spouses must sign. If a spouse cannot sign the return, see Publication 501, Exemtion, Standard Deduction and Filing Information, at our website Internal Revenue Service under More Forms and Publications for additional information."

    We filed our returns with H&R Block....and we asked the representative of H&R Block when we fillled the form and he said I dont need to sign the form 1040 as I dont have any Income for the year 2007. (Though file the returns jointly and moreover I dont even have the SSN).

    Pl carify whether I need to sign the form 1040 or not? We are so confused....That representative is not at all responding now. We couldn't contact him through phone. Pl help !!!!:bowdown:bowdown
