Any offical act of the President will have complete immunity if it can be established as official act. Anything that is clearly established as personal will not have immunity. However, anything that is debatable whether they are personal or official act, then, it should be evaluated/challenged whether this is done under the presumption of immunity through the lower courts. Dissenting opinion from Justice Sotomayor clearly states she is afraid for democracy. Most actions of the President will be immune from criminal prosection. The dissenting opinion says that the President could do so many actions that might be immune from criminal prosection some of which are unimaginable and I refuse to write here in this thread. It is interesting that the decision is 6-3 exactly in their political affiliation. In clear terms, in my opinion, President will be above the law unless the courts agree that he can be criminally prosecuted. The law that applies to common American may not apply to the President. Remember, even assasination of the political opponent using the seal team came during the case was presented. The Supreme Court gives this decision with the impression that there should be separation of powers but it looks like laws created by the Congress may not be applicable to the President unless the court agrees it is not an official act. I feel Congress' power is eliminated by this decision, making only the Judiciary having right when a President can be criminally prosecuted. Congress can only impeach the President by 2/3rd majority but the President will not be liable for the criminal liabilities arising out of his act. I look forward to your opinions.
President has absolute immunity of asking Department of Justice to investigate whether he lost the election and no prosectution can come out of it according to Supreme Court. Lucikly the military leaders rejected to intervene as otherwise, asking the military to get involved would have been an official act too. What is surprising is the following were referred to the lower court to find out whether the President has immunity: 1) Ordering his vice president to reject the electrocal vote counting. 2) Ordering his political party to organize fake electors 3) Ordering his political party to organize Jan 6th meeting just before the electrocal counting begins and their subsequent breaching of the Capitol Building. Is it really happening or am I dreaming it?
It is still a nation of law but those laws applicable only to the ordinary citizens but not to the President. The words, "Fearing for the democracy, I dissent" written by 3 Supreme Court Justices will reverbrate for many years to come. Presidential powers are enormous and now the question of whether it is legal or illegal order, the authority exercised by the President must be executed if it is official.
If the president is above the law then isn’t it a mockery of the justice system for everyone else? If I were a defense lawyer I’d be making this case for my client. A president is supposed to be better than the average citizen, not use their position with impunity. The 6-3 court split decisions will reverberate for generations.
It is. There is no question. We went back 248 years to accept the elected President as King, thanks to the Supreme Court.
If the ruling of this kind of immunity provided to the leaders in government, i wonder where it could lead a state like Tamil Nadu, Karnataka & Kerala. It would enhance the arrogance of those at the helm. Poor citizens!
I find populaity of Trump reaching record heights with this impunity announcement of SC. Long live (non)criminal acts. He has mopped more fund than Biden for election funds. A long report from PTI CLAIMS SO: Washington, Jul 3 (PTI) Republican presumptive nominee and former president Donald Trump has outraised incumbent President Joe Biden by over USD 67 million in the second quarter of this year by raising USD 331 million. Trump, 78, the presumptive Republican Party candidate, is pitched against 81-year-old incumbent President Joe Biden from the Democratic Party for the November 5 presidential elections. The Trump Campaign raised USD 331 million against the USD 264 million raised by the Biden-Harris Campaign during the second quarter of this year, according to the figures released by the two campaigns. However, the Biden-Harris Campaign outraised Trump in June, raising a record USD 127 million. Of this, USD 38 million was raised in the four days following the first presidential debate in Atlanta on June 27. The Biden-Harris Campaign has USD 240 million in cash on hand up from USD 212 million last month. Team Trump's cash on hand at the end of June is USD 284.9 million. President Trump's campaign fundraising operation is thriving day after day and month after month. Winning this quarter brought us a cash-on-hand advantage, which is punctuated by a Biden burn rate that grows while yielding no tangible results for them, said Chris LaCivita and Susie Wiles from the Trump Campaign. Despite Biden spending nearly USD 120 million on TV, cable and radio alone, polling and voter enthusiasm continue to grow for President Trump. This fundraising momentum is likely to grow even more as we head into a world-class convention and see the Democrats continue their circular firing squad in the aftermath of Biden's debate collapse, they said. June's USD 127 million haul was not just Team Biden-Harris' best month overall, it was the strongest grassroots month to date. Nearly two-thirds of June's raise came from grassroots donors, and of the USD 38 million raised following the debate, more than USD 30 million came from grassroots donations, said the Biden-Harris Campaign. This second quarter haul is USD 75 million more than Team Biden-Harris' raise in the first quarter of 2024. Since launch, more than 2.5 million Americans have contributed to Team Biden-Harris more than 1.1 million of them are brand new donors, it said. Team Biden-Harris also now has 1.3 times more recurring donations than at this point in the 2020 cycle, and 95 per cent of all donations are less than USD 200 another proof point of strong, sustained grassroots support, it said. Our Q2 fundraising haul is a testament to the committed and growing base of supporters standing firmly behind the President and Vice President and clear evidence that our voters understand the choice in this election between President Biden fighting for the American people and Donald Trump fighting for himself as a convicted felon, said Biden-Harris 2024 Campaign Manager Julie Chavez Rodriguez. President Biden is building a positive future for our country where every American has a fair shot, our rights are protected, and our president fights to strengthen our democracy not tear it apart," she said. "And on the other side, every single day, Trump becomes more unhinged and dangerous, whether he's bragging about his role in overturning Roe or proudly and openly refusing to commit to accepting the results of this November's election, she added. Democratic National Committee Chair Jaime Harrison said in June, Democrats had their best fundraising month to date. These dollars will go to opening offices, hiring staff, and spreading Democrats' message of hope all of which will power Joe Biden and Kamala Harris back to the White House," he said.
Dear Thyagarajan Sir, It looks like the Americans need a strong leader at the top more than the weakest who is reluctant to make tough decisions even his actions are questionable when he was the President. They are willing to forgive his crimes rather than inaction by the present leadership. It is unfortunate that most of them are not focused on righteousness. The Supreme Court decision emboldens the MAGA team to become even more rampant in their effort to destablise the rule of law. Perhaps, If Biden can show some courage by doing the following actions: 1) Quickly get a legislation for Ethics Law for the Judges and Justices passed in the Congress. I know the house is controlled by Republicans and let them go on record that they don't like ethics. 2) Meticulously ask Department of Justice to prosecute anyone who drifts away from the constitution and do treasoness acts. 3) Continue the prosecution of the pending Federal cases against J6 offenses including the ones that are against Trump 4) Settle the dispute between Israel and Palestinians through negotiated settlement 5) Engage in a conversation with Russian President Putin to stop the war against Ukraine and allow a Worldwide countries including China to negotiate a settlement. 6) Stop immigrants flowing into the southern border with strigent measures to send them to the countries from where they are coming in. 7) Make some stringent measures to make sure the social security and medicare payments are secured for the next several decades. 8) Reduce the fiscal deficit and stop borrowing more funds between now and the election. 9) Work diligently to increase the jobs and bring back outsourced work back to the US.
