Is it a law to take 2 Bedroom apartment if you have a kid?

    Hello all,

    I am looking for apartments in Atlanta. We are preferring one bedroom apartments as it fits in our budget. we have a 1.5 year old kid. We contacted many apartment communities. They say you have to take 2 bedroom apt. if you have kid. Is this a law in USA? or they are just telling because they want their 2 bedroom apt to be occupied so that they get more rent? In atlanta, in the area where we are looking, 2 bedroom apartment rents are 1400$ and above. And one bedroom rents are around 900$-1000$.
    Friends please throw a light on this.

    Under 2 years child, they don't have the right to deny. It is illegal for your apt management to deny.
    They are wrong, you can contest it. Or find another apartment which is family friendly.

    I experienced the same in Virginia as we have a 1.5 yr old and had to take a 2 BHK above our budget..

    When we were living in student campus, we were asked to move to a Two bed room apt once I got pregnant.

    Ive heard of this too...some people say it is a rule that not more than 2 people can live in a room...when my son was born, we had my parents over and were 5 people(including my baby) in a 1BHK. The landlord never cared about this...

    OP- yes, your landlord/ property manager can do that. Every state/ city sets occupancy requirements and the landlord has rights to enforce that limit- 2 adults per room or 2 adults +1. It seems Atlanta has 2 adults per room limit. That's what I remember as well. When I lived in a 1 br apt, I moved to 2 br apt in same complex before my parents visited me.

    Its a law in few parts of the country - varies from county to county. I have lived in places where it is mandatory to rent a 2 bhk if you are more than 2 occupants. The place I live right now does not have such law in place.
