In a divorce cases where the marriage ended due to one spouse's pre-existing medical conditions, does it matter who filed the divorce ? Typically in a divorce petition, there is a petitioner (the person who is filing the case) and respondent (spouse against whom the divorce case is filed); and this is indicated in the divorce decree as well. The divorce process is not impacted and remains the same regardless of who filed. My question is - is there a benefit (social/psychological/otherwise), especially women, in being the first to initiate the divorce ? Specifically, are people who have been divorced, asked about this detail when seeking partners later and are they viewed negatively if their spouse files first ?
I don't think it really matters who initiated or who filed a divorce case.....sometimes eventhough one partner is innocent, if the other one is crazy/cruel, he/she can file a case to harass the spouse..... In short, IMO the person who filed / initiated the divorce may not be considered as innocent......so it should not be a driving factor to go for 2nd marriage, also it may not be viewed negatively if their spouse files first (because the spouse who filed the divorce may be a psycho also)...... First of all don't bother about all these things.....end of the day we cannot change people & society and their thinking style.....only thing matters is our consciousness, whether we did right or wrong......if the other person is really understanding, he /she will definitely can understand the innocence of the victim, then whatever happened in the 1st marriage will never matters......
