    The panel also recommended that registration of marriages be made compulsory in all states irrespective of the couple’s caste and religious affiliations.

    The commission said that marriages between young adults below the age of 16 should be made void, while those between 16 and 18 be made “voidable” wherein the girl and the boy can fight to make their marriage legal. A “voidable” marriage means it can also be annulled with mutual agreement between the parties on attaining adulthood. The commission made these suggestions in a report submitted to the Supreme Court in response to a judicial reference. A copy of the 44-page report was also submitted to Law Minister H R Bhardwaj.
    “The age of marriage for both boys and girls should be 18 as there is no scientific reason why this should be different,” the commission said.

    भारत में शायद अब शादी करने के लिए लड़कों को 21 वर्ष की उम्र होने तक इंतज़ार न करना पड़े.
    वजह यह है कि देश के विधि आयोग ने सिफ़ारिश की है कि लड़कियों की तरह लड़कों के लिए भी शादी की न्यूनतम आयु सीमा घटाकर 18 वर्ष कर दी जाए.
    साथ ही उन शादियों को अमान्य करार दिए जाने की सिफ़ारिश भी की गई है जो कि 16 वर्ष से कम उम्र में की गई हैं.
    <!-- end_story -->विधि आयोग ने शादी के पंजीकरण को अनिवार्य करने पर बल देते हुए कहा कि अगर 16 वर्ष से कम उम्र में लड़के और लड़की परस्पर सहमति या असहमति से यौन संबंध बनाते हैं तो इसे दुष्कर्म की श्रेणी में रखा जाएगा.
    यानी इस दायरे में वे लोग भी आ जाएंगे जो 16 वर्ष से कम उम्र की अपनी पत्नी से यौन संबंध बनाएंगे.
    विरोधाभाष
    भारतीय दंड संहिता की धारा 375 कहती है कि अगर 15 वर्ष की लड़की को पत्नी बताकर सहमति से उसके साथ सहवास किया जाए तो इसपर कोई कार्यवाही नहीं होगी.
    वहीं दूसरी ओर विवाह क़ानून कहते हैं कि विवाह के लिए लड़के की उम्र 21 साल और लड़की की उम्र 18 साल होनी ज़रूरी है.
    दोनों बातों में जो विरोधाभाष है, उसे ख़त्म करने के लिए विधि आयोग को यह ज़िम्मेदारी सौंपी गई कि पड़ताल करके यह तय किया जाए कि भारत में शादी के लिए न्यूनतम उम्र क्या होनी चाहिए.
    हालांकि केंद्रीय महिला एवं बाल कल्याण मंत्री रेणुका चौधरी आयोग की इन ताज़ा सिफ़ारिशों से सहमत नहीं हैं पर आयोग का इसके पीछे तर्क है कि अगर किसी लड़के को 18 वर्ष की उम्र में मत देने का अधिकार है तो शादी करने का क्यों नहीं.
    आयोग ने अपनी सिफ़ारिशों को केंद्रीय विधिमंत्री हंसराज भारद्वाज को सौंप दिया है. सिफ़ारिशें तो कर दी गई हैं पर इन्हें पहले सरकार और फिर संसद की मंज़ूरी के बाद ही अमलीजामा पहनाया जा सकेगा.

    If these recommendations take the form of Law it wud be rediculous.This means instead of going forward it wud means going backword.
    Just for Equalising males & females - they shud have a equal marriagable age - Agreed - than why not make it 21 for both.
    By 18 yrs wheather boy or girl still are not mature enough for marriage & take the responsiblities .Their studies are not complete.
    They are still dependent on parents & don't earn .
    If marraiage is allowed than marrige discords,Divorces ,Pregnacies & early child birth ,misscarriges ,poor women's Helath cant be avoided.
    The argument that by 18 yrs if they are adult & can vote than why not for marriage is not correct.
    Voting is a one time occurence after that they are not directly involved by consequencies but marriage is a 24 hours ,seven days a week & 365 days year affair ,There is no backing out from it.
    The studies are usually not finished before 24 -25 yrs mostly if one is doing a proffessional course or much more than that ,so a right age is aroud that time.
    Our ancesters were much more wise & formulated the general rules which are worth even now .The division of life in brhamchrya 25 yrs
    Grahasthy from 25 -50 yrs,
    Vanprasth & followed by sanyas was a very good effort to bring hormony in life ,in society & earth.
    Registration for marriage is agood step.

    If a boy at 18 can wipe the tears of his lady love, understand her mood swings, can provide her the best of what she wants, ready to help her in house work, take her to the 'mall' once in a week, foot all the bills without depending on her, carry all respective burdens that a man carries after marriage successfully and independently, he can marry even at 12.

    If a woman is on the toe with respect to earnings or house work does not mean that the man has to take the back seat. Her income should always be a surplus income and he should not depend on it.

    I don't agree with this! Men maybe phsically mature at 18, but they don't mature mentally until................ Oh forget it!

    mujhe lagta hai ki....yeh illegal hi nahi....its doesnt make any sense..getting married so early...career banane me bhi time lagti hai na admi ko....

    I totally agree with owl and sugarnspice...marriage is not a joke it come with lots of responsibility n at the age of 18 boys are not at all mature..they are not even financial independent...so how they will handle there wife n family...

    At the age of 18 for guys is like having fun. Use and throw it. They wont stay with their marraiges frankly speaking. So the government should understand this.

    The guy also has to be on job with a house and everything if he gets married. If he is not doing any of these things unless uske paas baap ka paisa hai ayaashi karne ke liye then nothing can be said more.
