    Hello Ladies,

    I can understand the feelings of all the H4 Ladies who have been trying hard to find people who can sponsor their H1B visa which can enable them to continue with their working career. I can also understand the frustration people are in because of their inability to work. Each consultancy differs from each other and there are a lot of "IFs and BUTs" associated with each of them. Here are a few points I have seen from a website. They seem to be neat and logical. I request all of them to go through these once before filing their H1B

    Aspiring to go US and work
    -------------------------

    1. If you have less than 3 years of exp it is difficult finding a job after reaching US. Read the threads in which people are unable to find a job even after 4 months in US.

    2. You would be OK if you have 5 years of exp. Even then it is some what difficult if market conditions are bad

    3. You would do well if you have more than 7 years exp.

    4. Have a mind set that you will succeed in US what ever may be the hurdles. Lot of problems caused are because of insufficient courage and determination. I have seen people getting depression once they start attending interviews and getting rejected at several places. Their ego is literally shaken. They start recollecting how they were roaming in Indian companies as lions getting 25% pay hike every year and how they are beaten here in US. Unless you have the necessary determination you cannot succeed in US.

    5. Knowledge is very very important. I have seen 100's of software engineers in India not getting enough exposure. Most of them who are in maintenance projects think that they can do extremely well in US but fail miserably in US. Creativity is the most important thing here.

    6. If you are in testing or maintenance chances of you getting a job is grim. Professional consultants will not sponsor H1 for people with these experiences.

    7. Lastly, never come to US to save money to clear some debit / loan taken in India. Who knows, you may be empty handed even after spending one year here. You would have saved some thing had you been in India.


    Finding H1 sponsor - Offer Letter from Employer
    ----------------------------------------------

    1. Ask what is your total pay per annum if you are going to work in the place where your employer is located. Professional consultants issue offer letter even before they file your H1. If some one says it depends on the project then there are more chances that you would get under paid.

    2. Ask whether they will pay 100% while you are on bench. 99% of companies CANNOT pay on bench. They are not idiots to pay you about 4K to 5K USD per month when you are sitting idle. Professional consultants give you free accomodation and about $500 to $600 per month for you personal expenses till you get a project.

    3. The frequency of pay - Most companies will pay twice a month. Avoid companies that pay once a month or twice a month. They are financially weak.

    4. How much time you need to wait to get your pay. Normally you need to wait for 15 days to get your pay check. For example, for the period that you worked for Oct 1 to Oct 15 you will get paid on Oct 31 and for the period Oct 16 to Oct 31 you will get paid on Nov 15. If the period of waiting is more than 15 days it means unless your company receives payment from customer they cannot pay you and your company is financially weak. Waiting period in big MNC's vary from 1 to 7 days. Professional desi consultants do it within 15 days.

    5. Most of the companies would require sharing some expenses of filing H1. You can pay upto $2500.

    6. Ask them when this will get refunded. Professional consultants will refund this amount on the next bank working day of your arrival in US. You can judge your consultant based on when they promise to refund. Some will refund with your first check once you are in project, some will refund after one year, some will never refund.

    7. Ask them who will pay for your flight tickets from India to US. Professional consultants will buy and send eTicket for you. You are lucky if they pay for your spouse also.

    8. What happens to the money if you got 221G? Most of the candidates applied by professional consultants will get H1 even after 221G since they will send all necessary documents. If you did not get stamping even after 221G even professional consultants cannot help because the amount is already spent for filing your H1. You have to fore go that amount.

    9. Ask them whether they have projects. Professional consultants cannot guarantee a client and project almost 8 months before you arrive in US. It is too immature to ask this question. If some consultant says that they got a client and you can start working with them on the day of arrival, 99% it will be a false statement.

    10. Ask about the contract period with them. Professional consultants will require you to work for them for a period of 18 months on project with them.
    If you are on bench on 6 months then you have to work for them for 2 years.

    11. Ask about Green card if you are interested.


    Preparation of H1 petition
    ------------------------

    NEVER EVER disclose about your H1 filing with your friends / colleagues because there are so many things can go wrong in the process. Some people simply show off with their colleagues about their capability of getting H1 sponsor but eventually getting rediculed if for some reason they did not get their stamping. Their efficiency in their current job is terribly affected because of the failure to get H1 approval and stamping.

    So DO NOT TELL ANYONE TILL YOU GOT STAMPING.

    Your H1 approval depends on so many things.

    1. Your application has to be accepted by USCIS through lottery.
    2. Your educational qualification, experience letters play an important role in the approval process.
    3. Consultants financial capability is another important role.


    Once your H1 is approved you are ready to go for stamping

    Visa Stamping
    -------------

    1. If you are married always apply for your spouse and kids irrespective of whether they are going to travel with you or not. H4 approval is automatic if your H1 is approved. Getting H4 for them is much more easier when you go for H1 stamping rather than going for H4 after you are in US on H1.

    2. If you got 221G and AAP you cannot do any thing and some times professional consultants also cannot do anything. You have to wait .. wait and wait..

    3. Never give false hopes to familiy members / friends that you are going to make hell a lot of money in US and make them feel jealous about you.

    Arrived in US - Welcome to USA
    -------------------------------

    Once you arrive in US then everything is in your hands. Your empoyer can only arrange interviews and you ONLY have to clear. If for any reason you are getting rejected analyze the reasons. This is where people's ego is shaken. Every one has a braking point. Beyond that they are not able to control and start looking as if the whole world is against them. If you are not getting job it is your fault.

    1. Never be greedy.
    2. Always be very attentive and look for opportunities
    3. Refresh the fundamentals of your skill set area while you are waiting for the project.
