question on evicting a tenant hi my tenant just moved to my flat before 6 months.we had a 1 yr agreement... but he had been giving problem,right from the 3rd month... what are the various ways, that i could evict him... this is in chennai...is there any legal way i could go with....
Re: question on evicting a tenant vahrija, If you have gone for a 11 month agreement, with both parties signing, you would have mentioned a clause of two months notice period, if either of the parties are not happy, so you can always issue a notice saying that you need the flat for your own use, as you are planning to shift there. these days many tenants are taking nri's for a ride, they abuse the flat/house very badly. many people now opt to keep their property locked these days.
Question on repaying the rental advance My tenant has evicted my house but the house is in a pathetic state. The marble and tiles are very dirty and there are some broken glasses. The age of the flat is 6 years and the tenant has also stayed for 6 yrs. The bathroom doors are slightly broken. We had taken an advance of 50,000. I guess some amount could be detected from the advance. Can somebody throw a light on this????
Re: Question on repaying the rental advance Hi Subasrilatha... You can deduct from advance if you have put a clause in the lease deed pertaining to that. But six years is a fairly long time and wear and tear are bount to happen. Tiles can be acid cleaned.Marble cleaning is not that successful if the stains and dirt has seeped in deeply.
Re: Question on repaying the rental advance like shakambari said, if it's in the lease yes you can deduct. but like she pointed out, the normal wear & tear over 6 years should be taken into account. if there is a breakage then that can be recovered. but if it's not in the lease, then mutually both will have to agree & get couple of quotes for the repairs, then agree for the amount to be deducted.

Hi guys, A simple question.. silly maybe. But I need some clarifications... In Chennai what is the norm for payment of house rent.. I've got a tenant who has just moved in. He's paid his advance. When should the rent for the current month be paid? Does he pay it beginning of the current month or the beginning of next month? Thanks, Sylvia.
Re: House rent payment Shakambari.. just to be clear, .... so he should pay his JAN month's rent in the 1st week of JAN. Is that right? This is becos he and the broker told me that this month's rent will be paid 1st week of next month. They said its the norm in Chennai. Thanks.
Re: House rent payment The broker is right. If it is Dec rent ,the tenant pays it by the first week of Jan. After all he has given an advance deposit!
