    Our justice system is based on the premise that better that 10 culprits go free than even a single innocent is punished. No doubt that is as it should be

    Incidents such as yesterday’s ‘encounter’ are certainly worrying. Tomorrow it could be any of our near and dear ones who might be wrongly victimized for some crime they never did. But the wide spread reforms which we all want in the judiciary as well as the police force might never happen or even if they ever do, there may be many females who will fall victim to such crimes by the time those changes are in place. Will our parliament have he gall to legislate some severe punishment such as castration for all rapists and their accomplices (like in the Unao case) within a week? Will they legislate that once an accused is convicted in a fast track court, he will not have the right to appeal in any other court or to the President? That is the kind of urgency and deterrent which will be needed to put the fear of God into the minds of potential rapists in this country.

    We shudder for our male relatives who could potentially be victimized in such actions. Do we shudder equally for our female relatives, near and dear ones who could be victims of such crimes if potential criminals are not stopped in their tracks for sheer fear of such consequences - right or wrong?

    An Unnao is what happens when the justice system takes its own course and the 'accused' are let out on bail.

    If all men including terrorists (like Kasab - he was even given 5 star treatment in jail at the tax payer's expense) and rapists have a human right to be innocent unless proved guilty (sometimes even with thousands of eye witnesses and CCTV footage as in Kasab's case), what about the women? Are they all 'guilty' (not innocent) or are their lives of lesser value? Is it fine for men to throw acid on their faces, rape them, burn them, mangle them .....? It is all fine to talk unless one is the victim or a near and dear one is affected. Instead of blaming the people who are baying for justice, it is time to criticize the lack of quick and efficient justice for the victims? Question the failure of the police in taking the victim's father and sister seriously when they went to lodge a complaint. It is becoming a crime to be born female in this country. And YES. ANY MAN irrespective of political of financial clout who dares to rape or molest any woman MUST face the same consequences.

    In this particular case, I have no praise for the police. They did not do this out of any innate sense of justice, but just to cover their own backs after the way they botched up the case on the very first day. I am furious that the police involved are only suspended and not thrown out of their jobs.

    No justice system is infallible. Even if it were the judiciary which sentenced these people to death or even life imprisonment, there will always be a risk that an innocent is falsely implicated.

    So do we eschew human justice altogether to ensure no innocent ever gets punished?

    Read section 228A Indian penal code. Our society has to be repeatedly reminded not to shame survivors and victims of sexual assault

    Just what I am saying.

    By doing this, the practice of considering a woman as stripped of her honour and dignity is perpertrated, while there is no shame attached to the perpetrators. Just saw a news telecast which states that the police are siding with the perpetrators of the Unnao atrocity. We tend to swing between shaming the victim and glorifying her with names such as Nirbhaya, Dhairya and 'desh ki beti'. This patronizing attitude is sickening. Are we incapable of treating a victim as what she is - a victim like a victim of murder, theft etc.

    It was well known fact that Kasab biryani story was spread by lawyers to form publicly opinion ... the prosecutor himself mentioned it after the case is done.

    this is how people opinion is managed that after years we come and comment on five start treatment to a terrorist ... obviously the public does not bother about facts ... emotion takes over...

    the same public stands and takes procession out in support of Kathua rapists ...

    the same public supports election of Prague Thakur and Mla senger... the same public worships chimyanand , asaram Bapus and nityanands and move onto new god men when old ones loose names

    same public was against police two days back and now forgot now that the police did not write FIR when approached ... may be if they acted swiftly they could have saved the girl ... now they earned laurels ...

    They take advantage of public sentiment ...people were having protests against police and govt ... this turned tables ...people opinion can be easily managed when every wrong be termed right because public supports it

    We have instances of public lynching of people based on what’s app messages and we all know power gets misused , so it is very imperative that the encounter needs to be questioned ...

    It is also need of the hour to see what loopholes need to be plugged and time bound implementation of sentences ... but it is not acceptable that we give instance justice without knowing accused are culprits are not ...

    Pragya thakur was accused of the terrorism. She has not been proven guilty.
    She too underwent lots of torture by the police on the orders of police.
    Lots of Indian girls get raped
    Why talk about only kathua??

    Yes, social attitudes need to be changed. Judicial system and police need to pull up their socks and major changes need to be made. This is not going to happen overnight. God knows how many years it will take for changes to be effected and how many more years for them to have a deterrent effect on the psyche of rapists. Do we have any solution to ensure that there are no more rapes in the interim period? Or is it the destiny of Indian women to keep taking everything that comes their way until all these changes happen? Until then the human rights of the criminals will certainly be upheld and protected.

    The sad thing is we can go on writing about this and keep reading endless articles/blogs ..... but nothing will ever change.
