Where to get permission to start an orphanage?

    well, i tried to find contact of clifton, didnt find any mail id..

    this is sumanth writing from rajahmundry, andhra pradesh a small entreprenuer, worked in usa for a couple of years and now im back in my hometown,

    so the thing is about starting an orphanage.. i think i got enough people to help with the finances to run it, but im looking for helping hands to start, i mean to form a group or something.. gather info about the procedures, forms, dealing with govt, because i willbe having quiet a bit of people sponsoring from usa, so extra certifications etc..

    well if any body around my location came through this post and interesting in joining hands, although if youread the post after an year, you can contact me..

    how are you doing with your idea of setting up orphanage? I have the same idea, want to set up a small orphanage somewhere in Gujarat, I want to use my savings to do that. And I'm looking for a help from people who had an experience of doing that. If anybody has suggestions and advice for me, plz contact me

    Dear Mr. Clifton Shipway,
    I appreciate your great idea of setting up an orphanage in India, all the way from australia you have come. I have been struggling with the same dream to set up an orphanage for the igonored children with an intention, to try to relate the pain, suffering and sadness of an orphan (or abused child) feel after reaching adulthood. What I wish all of us to think that why not he/she has a right to live as equal to every individual on this planet. This thought reminded the responsibility to protect their important part of their livelihood by providing with an opportunity to transform their orphan hood into a natural lively hood.<!--?xml:namespace prefix = o ns = "urn:schemas-microsoft-com:eek:ffice:eek:ffice" /-->
    Conscious alerted to review the responsibility as human being that ignited mind to create an environment, to adopt the child hood of these innocent children, that convinced me to set up a school called “AN OPPORTUNITY SCHOOL”.

    My project aims to provide support to the ignored children to help them position themselves confidently within the learning process and to create a tangible dynamic atmosphere, which encourages them to build up confidence dimensional skils by ​

    way of:

    1. Transformation
    2. Education
    3. Skill Development
    4. Employment

    Create such an environment, where the early age of raw orphans children’s are considered, to transform their negative side of their life, attitudes, ignorance, skills into very positive turbulent energy, and convert their ignorant image by the society in to reality, so that ignored childhood would be given a chance to prove themselves a social able citizen. The proposed activity will be made into reality in the phased manner in not latter than Four years of the span from now.

    Unfortunately there has been a great delay in making this project reality. I would love to know more about your present status of your project and interested to discuss more on this. Pse.

    Hey everyone, I really am sorry to have not replied until now. Actually I didnt even know that anyone had written until I randomly stumbled back here.

    My orphanage that I run is called "The Good Shepherd Agricultural Mission" it is based in Banbassa, Uttarakhand. If you google us you will be able to find our website and get in contact with me.

    Here is some information that I have kept on hand to help those who are interested in getting an orphanage running I am by no means an expert (not in any way) but I do have some what of an understanding:

    Starting any non-profit organization is anything but easy but these are some of the most important aspects (not all but some):

    · Acquire a piece of property to base the organization (if possible eventually have it registered in the name of the organization) or find somewhere willing to give a legal lease for long term (i think the minimum is 5 years but i am not sure).

    · Get as many letters of support as you can as fast as you can, from local buisnesses, politiciants, dignitaries, foreign businesses, local panchiats/village heads... etc. These will all help to avoid delays/proplems in your registration/setup process. A "Letter of Support" can be as simple as a person writing "I am in support of the work that ____________ is proposing in the Orissa area. If you are able to support it we would appreciate it.". You can actually chain these letters off other people, ie start with the "smaller people/businesses" anduse a collection of the letters from them to get letters out of bigger and bigger people/positions/offices. You would be surprised the amount this can help.

    · Register the organization as a Society (this is done through your local Registrar of Societies), if you need help finding them ask at your local Thasil (ie ask an SDM or even a lawyer there at the courts). For this you will need a Board Of Directors, By-Laws and a few other things. You can ask at the Registrars Of Societies office about this (ours was done in 1948 so I am not sure how it is done now).

    · If you want to get funding from overseas you will need an FCRA Number and bank account. This is done through the Ministry Of Home Affairs in New Delhi. A FCRA is in accordance with the Foreigners Contribution Regulation Act of 1976 (an act which you will probably need to have an understanding of). The application process is straightforward but seems to take a lot of time.

    · You will also need to register your society for a PAN number. After this you can ask at your local tax office about applying for a “tax-free” status. If you want people who donate to you from within India to be able to claim the donation as "tax deductabile" then you need an "80G Certificate" this is pretty complicated and you will need the help of a Chartered Accountant.

    · It’s a good idea to have a permanent accountant and a lawyer. The accountant does not have to be a certified accountant (ie a chartered accountant) just someone to keep account of your income/spending and then every year you will need to take your papers to a Chartered Accountant who will then certify them and you can then register them with the taxation office.

    · Registering as an NGO is also a good move but you will certainly need a permanent accountant and lawyer for this. Lots of different documents are needed for this such as a Memorandum of Association or Bye-laws, including applicable rules and regulations; report of annual activities, financial reports/audit reports, sources and pattern of income & expenditure; minutes of the Executive Board or General Assembly that endorses the setting up of the NGO; letters of support (references from MLA’s, pradhans, SDMs… ) etc.

    · Finding funding is a difficult thing but if you register as an NGO you can apply for grants from businesses and other NGO’s.


    There are loads of great books out there on this type of thing, most of them are regarding starting and NGO but all of the steps for starting a non-profit society are pretty much the same right up to the NGO status application. One of the books that I find most useful is called "Legal Handbook For Christian Services In India" which should be available from Christian Bookstores in India... even if your not a Christian there is a lot of relevant information in there for non-profits and especially those involving foreigners/foreign aid.

    There are a bunch of laws that you need to be aware of, it is good to have these books on hand most can be bought online through the Eastern Book Company:

    Societies Registration Act
    Foreign Contribution Regulation Act
    Income Tax Act
    Law of Adoption, Minority, Guardianship & Custody


    Some others that are nice to know too:
    The Constitution Of India
    Payment Of Wages
    The Minimum Wages Act
    The Charitable & Religious Trusts Act
    Basic Education Act
    Right To Information


    That’s really all that I can think of from the top of my head. If you have any questions I can do my best to answer them (though I am certainly not an expert in this matter). As far as starting cash goes for an orphanage of around 30 kids, as long as you had the building already I couldnt imagine it being more than US$10-20,000 to get completely registered and equipped. The hardest thing by far is getting the initial start up money into India and the FCRA registration -this can take anywhere up to 6 months to 2 years or more to get permission to receive funds from outside India.

    Right now I am in Australia and working for a Company and checking out the details to start an Orphanage in my home town (Andhra Pradesh) in India ...
