How Do People In Usa Without Friends Or Relatives In India Manage Their Property

    Like the topic says - I am curious to know how do people in USA without friends or relatives in India manage their property? If any legal work needs to be done how do you find a lawyer and ensure he can be trusted without any references by people known to you? If you are renting your property, who manages it for you?

    Yes. That's the plan. However, to sell it legal documents need to be made. But I'm not in a position to go to India. A typical catch 22

    What legal documents you need for selling ? You should have everything already with you. There is only one legal document which should be with you .

    Either you should be there to sell or need to give power of attorney to someone who complete the deed in your absence . Based on your location you can find reliable brokers who will be willing to do the selling for you. They usually get 1% commission. Based on your location you can do Google search and find them. Lawyers you don’t need them for selling. Only for buying you need lawyer

    I need to apply for and get numerous docs like succession certificate, title certificate etc. If it was just the deed, selling would have been a cakewalk :cry:

    I have an apartment in another state whereas my family is in another state. So they can't come and mange all those things for me. I have rented it out for last few years and everytime a tenant leaves, I will book a professional cleaning service who does all the cleaning and painting.
    And I will place the ad and my contact number. It's little tough until we get a new tenant. And we struggled a lot during pandemic and house wasn't occupied for many months.

    Managing is depends on what type of property you have.

    I haven't heard of succession certificate and title certificate. Are you talking about kaatha?

    What type of property you have? Is that given for rent?

    If the property is owned by you, all you need is your title deed along with the Power of attorney in favor of someone who can executed the sale on your behalf. If you are residing in a foreign country, the Power of attorney has to be executed by you in the presence of a Notary and the Indian Consultate should endorse your credentials on the Power of attorney. This is a requirement in many states in India. You may also need encumbrance certificate that there are no loans outstanding against your property and if there are loans, then, you need to agree to pay that debt first before getting your sale consideration. I am not sure why you need Succession certificate unless it is owned by your parents prior to your inherittance. If it is owned by your parents and you inheritted it through a Will, then, you need to probate the Will in your state before selling the property. Normally, the buyer will prepare the sale deed but if you like to review it with the help of lawyer before executing it, then, you need to find a lawyer to review it on your behalf.
