@Agathinai, Please read the Wikipedia attached. Article 370 of the Constitution of India - Wikipedia Article 370(3) clearly states that "Provided that the recommendation of the Constituent Assembly of the State referred to in clause (2) shall be necessary before the President issues such a notification". Isn't it clear that the President's issue of such notification without the recommendation of the Constituent Assembly of the State is unconstitutional?
Yes. I do understand what you are saying. This is the online copy of the new constitutional order, just first page I believe. They had given some clarification regarding this. I don’t understand the legal issues here but just sharing what I read online.
@Agathinai There is no concurrence from the Government of J & K is my point as it is under Governor's rule which is administered by the Government of India.
American Government is getting ready to pull out a lot of troops out of Afghanistan (cutting cost of this long-term war) provided Talibans and the Government in Afghanistan agree not to let Al Quida back into Afghanistan. The Afghans are tired of fighting wars for Al Quida as well. President Trump wants this withdrawal to begin before the Presidential election in 2020. Pakistan is helping this negotiation and hence Taliban will stand firmly with Pakistan to help them fight a war to liberate Kashmir. China is backing Pakistan as they have an eye on Ladakh region. Neither Russia nor America want to get back into a war in this region. This may not be a good time to scrap Article 370 even though I am not a big fan of Article 370. Mr. Amit Shah and Prime Minister Modi lack strategy and I have to agree with the OP that the Government of India is doing a lot of theater showing courage without seeing the long-term well-being of the country.
Precisely Viswa, this is an inauspicious time to scrap the article and further alienate the Kashmir. Trey are ONLY doing theatre But now they have the tiger by the tail. They can't withdraw the extra troops they have piled up in Kashmir without letting the insurgency rise.
Kanths, it is easy to talk aboout free movement and investment. Who would want to unvest in an insurgency-ridden state? The revocation of thr two articles will lead to the insurgency peaking and the govrnment is struck in a vicious circle, I am afraid. Golvernance must be moore than just dramatic announcements.
Satchi rest assured . I don't see the natural beaty and ecology being destroyed in the Kashmir valley because I don't see investments coming in into an insurgency hit area . But I am concerned about Ladakh Already there is talk of generating Hydel power there. That could affect the environment. On Kashmir I don't see things taking a good turn.
Thyagu sir, I don;t see any "strategic thinking here, only gross political miscalculation. When BJP was part of the state government, it tried to engineer defections from the senior partner PDP but failed. So after bringing in president's rule it is now trying to rule the state from Delhi making it a union territory. Only political expediency is visible here, no statesmanship.
Shall wait and watch. Already heard a plan for Medanta Hospital to open up shop in Kashmir yesterday and today an industrialist expressing interest.
