Urgent Help Needed For My Friend

    hello ladies

    Urgent help needed .. my friend com colleague had a problem now am seeking advice on behalf of her .. she met with an accident recently basically a cyclist hit her car while turning left.. she told she yield correctly but cyclist came too fast n there is not much she could do to stop as she is on road middle .. he hit at the read end got small scratches nothing major ..

    Now she got a ticket on that day saying failed to yield which she is contesting ..

    She has a court date tomorrow but unfortunately she lost her I’d yesterday .. it’s weird sad ..she says she had it until Thursday went to post office for her daughters passport renewal ..

    Now what she can do ..? What if they ask about her drivers licence can she tell she lost it .? Does it sound like silly for them like loosing it just before court date ., what additional document she can take with her as address proof ..?

    She is very down now n crying scared of what judge n lawyer will say ..? They might think she is negligent n say she is guilty ..?

    I have suggested like talking passport n company I’d with her along with her . N try to convince them .. they may or may not belive ..

    Please suggest what can be done ..?

    Ask her to go to the motor vehicle agency as soon as it opens and apply for a replacement license. Does she have a photocopy? Also try to get a lawyer.

    Yes she has a photo copy luckily took an passport renewal day .. the court is at far distance n need to appear by 8 so for commute it takes 1 1/2 to 2 hours so going to dmv may not be possible in the morning ..

    Yes they have a lawyer representing she tried to call but they are closed on Sunday ..

    Also she told like she still have her learners licence can she show that ..?

    Does lawyer will take care of this matter and believer her she is not guilty ..?

    1. File a police report. The first question the judge will ask when she says "I lost my ID" is "did you file a police report?" Call the nonemergency number of your local PD and report the loss. Ask for a police report. It will help during her court hearing and in case her identity gets stolen.
    2. Put a credit freeze on her credit report at all three monitoring agencies. This will prevent her license from being misused.
    3. Carry alternate ID like passport and a photocopy of the driver's license to the hearing.
    4. Apply for a duplicate license and carry proof of the application.

    Just saw your post saying that she has a lawyer. That's about the best she can do at this point. Good luck to her!

    I just checked our state's MVA and you can apply for a duplicate license online. They do not require reporting of a lost license first. If that is possible in your state then your friend can do that and provide the email receipt as proof.

    Thank you malstrom/ gauri for your quick response ..

    I asked Same question she dint file police complaint she thinks she might find it at post office where she present for passport renewal ..? She dint loose any credit cards .. is not filing police complaint is bad ..?

    Yes she has all other documents like passport photo copy of lost licence n untility bills n company I’d proof ..

    The thing is her husband is not co operating at this time shouting at her that she is negligent n lost her I’d .. I am driving her to court tomorrow ..

    In terms of the case it might not be a major issue though she should confirm with her lawyer. She should stay calm and be confident at the hearing. Losing a license is not a crime. Mistakes happen. Even the law enforcement guys understand that. She can call and file a report tomorrow morning after checking at the post office. It will protect her from potential misuse of the license. In case of ID theft she will have a legal fallback. I have done it myself. It is a quick process.
