MY two friends, working in the same school got married in a temple in presence of 5 colleagues and their families. they have declared thet they have married to each other in the affidavit needed for House Rent Allowance maximum limit availability. They both cut their amount to maintain the limit. But their marriage has not yet registered. Should they need a legal divorce?

Yes. Though registration of marriage is required now in India a marriage does become void in the absence of it. The marriage has been solemnized per Hindu rituals so neither can remarry in the absence of a legal divorce.

    They are legally married.
If the marriage has not been consummated...they can get it annulled.
