Well, if there's anyone to be blamed for this fiasco, it's got to be SPB Charan! As the organizer of the show, it's pertinent to know your rights and the things that should be done and/or avoided in organizing the show, which obviously Charan had missed big time.

In fact, as far as I know, ARR is the only other MD who has obtained full copyright of his music and words has it, that SPB actually pays royalty to ARR before singing ARR's songs in public. Thus the question remains, if he can do it for ARR, why not do it for IR? In any event, the notice didn't prevent SPB from singing IR's songs, it only says that singing those numbers without IR's permission is legally wrong, which of course is true! So, what Charan could and should have done is merely to seek IR's permission for those songs, and possibly pay royalty if the same was demanded.

 

Yes, if the lyricists have registered their rights to them. The problem here is that lyricists and music composers do not do so, which is how and why their works can be easily infringed by others.

If I'm not mistaken, the original position is that the Film Producer has the full rights over his movie (and that includes songs, lyrics, tune etc) and these Producers in turn sell those rights to music companies. So everytime a music composer wishes to reproduce or perform a particular song , they need to seek permission from the music companies. ARR was the first person to demand that the music rights are held by him (that is in fact the reason for SRK-ARR fallout in Om Shanthi Om). As such, now he is free to use or reproduce or perform any of his songs wherever he wants to.

What probably irked IR was the fact that his songs and tunes are used /rehashed / stolen lavishly in new films and yet, he's not given any credits for the same. We may recall that at one point, every other Tamil film that was released used to have IR's famous tune at the background (Subramaniapuram, Kalloori etc). But he couldn't do anything as he was not holding copyrights to any of his compositions. Thus, it was during that point that he probably wanted to change the situation and therefore registered his rights to his compositions. So instead of seeking permission from the music companies, all people has to do now is to seek permission from IR instead.

Coming back to lyricists, I don't think any one of them have registered their rights to their work, which is why no permission need to be obtained / royalty to be paid to them before performing their songs.

IRs weren't there in 70's and 80's - so raja was deprived of rights. arr was much later and he was prudent as IRs were there and he got them. raja had difficult times getting IR for his songs.

Good to know! IR-SPB-SJ combo had been like a drug for most of us.. Intoxicating their songs are.. We don't want any unpleasantness between them. Hope they settle their issues amicably.

 

In the ongoing paternity dispute case where an elderly couple Kathiresan and Meenakshi have claimed that Dhanush is their son, the stage had come where birth marks on the body of the actor had to be examined and corroborated with those claimed by the couple.



The court had appointed two doctors to examine the birth marks and they had come out with a report that says that the identification marks stated by the elderly couple are not on the actor’s body.



We quote below a few points from the report given by the doctors

I. With regard to first query, there is no mole over the left collar bone and there is no scar in left elbow.

2. With regard to second query, it is possible to remove a small superficial mole completely but a scar cannot be removed by plastic surgery and only scar reduction can be done.

3. With regard to third query, a very small superficial mole can be removed by laser technique without any trace. A removed large mole, traces can be seen by Dermascope but a scar cannot be removed by modern plastic surgery only a scar reduction can be done.



When we spoke to Madurai Medical College Dean about this case he was reluctant to reveal anything more about this issue, "I had already submitted my report to the court. Media have been twisting my reports and carrying their own versions of the issue. Some news is contradictory to my report".

 

Isaigniani Ilayaraja’s sudden legal notices to SPB, Chithra and Mano has received a lot of flak in the industry even though he is only trying to enforce an existing law. The latest to go all guns blazing against the maestro is none other than his brother Gangai Amaran.

Gangai Amaran has said that Raja’s songs are like an incessant shower of music and people like to be drenched in it all the time and he cannot claim royalty to the people who hum him. He has questioned Ilayaraja if he had paid royalties to the Thiagaraja hymns that he had sung. Gangai Amaran has also pointed out that the legend MSV and his contemporaries never exercised the copyright law for their songs. He signed off by musing what Ilayaraja is going to do with the money, whether he is going to do something for the people, his children or siblings.
