H4/domestic Violence/alimony

    If a H4 holder is abused by husband and files a domestic violence case, would she have any chance of getting alimony/child support? Assuming the husband is imprisoned and then deported, how would he afford to pay?

    Best to ask a lawyer. If he is deported and she is a dependent, she may need legal help to even stay on in the country.
    If he leaves, she might have to take it to the Indian courts. If so, it's a long and heart wrenching process. I wouldn't wish that on anyone.

    The bigger prob will be the status. H1 is only valid with a current pay check. Once the guy is arrested and without a job /deported the H4 which is linked to the H1 is no longer valid.
    She needs to talk to an immigration attorney ASAP.
