Gc applied and H1 stamping

    Me and my husband have applied for GC under EB 1. it is still in process.
    his H1b visa is not stamped. he has not been to India since two years. i came to india bfore we filed for GC and my h4 is stamped. Can he come to India and have his visa stamped as GC is in process.

    please let me know your views.

    Yes, once he gets out of the US, to re-enter he needs to get his H1B stamped.

    Hope you and your husband have your h1b extension approved papers, GC filed papers, carry the copies of them during the travel. Take an appt. with the US consulate in India for H1B stamping during your stay there.
