    Hi,

    Does anyone know about any rule that spouse of H1 can start working (or can transfer to H1) if H1 has been for more than 3 years?

    H1 can be applied by h4 visa holder any time.

    The rule is still in works. Nothing confirmed yet. Will probably take several years before it gets passed.

    Hi,

    Thanks for the reply. But when I apply for the job they dont do h4 to h1 and assumes that we will be able to start working from october 2014.

    Haveyou written in your resume that you need work authorization to work in US? Have you selected the 'Need work authorization' option in the job search websites where you have uploaded your resume?

    There is nothing called h4 to h1. Your prospective employer files fresh H1 and when approved, your status is changed from H4 to H1. If your H1 is filed by a cap exempt employer(non profit organizations such as hospitals,universities etc.) then you can start working at any point of time.This H1 cannot be transferred,nor cannot be switched to cap subject one. If H1 is filed by a cap subject employer(private firms Ex: IT) then you can start work from October of the current year.
