Moving To India For Good

    If you are worried about your safety here in the US, people will take more advantage of you if you move to India.
    Don't move to India just because you husband loves to settle there. What about you? What do you want? Please think it through before you make a decision.

    Hi @kveena ,
    If you have issues with inlaws and if you feel he is a mommas boy, it’s better you stay here.
    Once you reach there you may have to face more issues.
    As others have already suggested, can you come back to US if you are not happy in India?
    Wat about your parents? Do you think they can manage for few more years?
    Any kind of harassment is not acceptable
    Do what is right for you and your kids. Stay safe!

    Thank you all for your love and advice. Currently I am in India for a short duration.I have conveyed the message to my parents and fil.My parents have decided to give a firm answer if and when he brings up the subject.My Fil assured me that he will try to solve the issue (my Mil tried her best to prevent me from talking to her husband).We are just waiting for him to land in homeland and yes I do have an option to return back since I am a permanent resident.I will stay strong for the sake of my kids and parents!

    I hope you know the following. More at the source FAQ.
    I am a lawful permanent resident of the U.S., can I leave the U.S. multiple times and return? (link to full information)

    If you are a lawful permanent resident (green card holder), you may leave the U.S. multiple times and reenter, as long as you do not intend to stay outside the U.S. for 1 year or more.

    If you intend to stay outside the U.S. for 1 year or more, you must apply for a re-entry permit with the U.S. Citizenship and Immigration Service (USCIS) prior to leaving the U.S. Re-entry permits are generally valid for 2 years from the date of issuance.Therefore, if you are outside of the U.S. longer than the date the permit was issued, you may be denied entry into the U.S.

    (back to Amulet:) The USA does not give you a "departure stamp" on your passport when you leave. Sometimes, India Passport Control skips giving arrival stamps for India-passport-holders, and simply wave them in. Such behavior is not very helpful to US Permanent residents who intend to stay away from the USA for months at a time. Be very cautious in saving all the records of departures (airline tickets etc.) and returns, because as Murphy would put it:

    We have seen cases of girls who (totally trust their husbands to) let the husband take care of money management, and tax returns filing issues. For long absences from the USA, aside from the risk of having the PR-visa (aka Green Card) expire, there is also the risk of lapses in the annual tax-filing ritual.

    Permanent residents of the USA will have to continue filing their US tax returns no matter where they live, unless they can provide evidence that their income is below the level for filing requirement. Being married makes a person legally liable to the taxation problems of their partner, if there are any. And more importantly, when it comes to legal matters, ignorance of the law is not a good defense.

    A man's ability to ignore the girl he is married to increases in India; a married girl's civil rights are in jeopardy in that scheme. This is usually the reason why long-absent NRI's, especially those with girl-children, are nervous and reluctant about a permanent return to the situation they had escaped from.

    If you really really need to go back to India for a longish period, I would recommend that you wait till you get your USCitizenship, and the OCI card. With these documents you and your husband will both be employable in India, if you need to work. And besides, there is no issues of having to get a reentry-permission stay longer than 2 years, and there is no cost/hassle of applications forms, and waiting for getting that re-entry permit. You can also vote in US elections by mail. And your children (if they are also USC-OCI) do not have to struggle to get a student visa to go to USA for higher studies; and all the back&forth travel-to-USA costs (to sustain the PR visa) that are avoided, may be used to pay college expenses for the children.

    Your safety is the most important consideration.

    If you have extended family/friends in India who would help protect you, consider going back.

    If you don't have support in India, stay in the USA.

    Other factors are relevant but less important. They come into play only after your security is taken care of.

    It might be not the first time you going to tell your marital issues to your parents and in-laws. How much of the issues solved previously? Are you sure talking with your H by parents and Fil will bring any change into the situation?

    Make a list of things what you want to be changed by H or overall situation. the discussion goes around instead of points when all sit to talk and he doesn't like to be pointed out.
