I stumbled upon a concept called "Lemon Test" from one of the news outlet's op-ed column on Sabarimala verdict. ...the "Lemon test" details legislation concerning religion. It is threefold: - The statute must have a secular legislative purpose. (Also known as the Purpose Prong) - The principal or primary effect of the statute must not advance nor inhibit religion. (Also known as the Effect Prong) - The statute must not result in an "excessive government entanglement" with religion. (Also known as the Entanglement Prong) Factors: - Character and purpose of the institution benefited. - Nature of aid the state provides. - The resulting relationship between government and religious authority. If any of these prongs are violated, the government's action is deemed unconstitutional... Unfortunately, such a litmus test isn't available in India for the KL govt to assess the court's involvement, its own stand on the issue and to whether or not implement the law. What do u think? Sabarimala verdict is "constitutional" as per the listed conditions and factors? Just being curious here, from an analytical and learning point of view.
Was an interesting read. I am not so sure about the exact reason why this verdict was even given. Naan pala dhadavai yosichen aanaal badhil seriyaaga theriyavillai. Constitutional aa ilaiyaa endru kooda theriyaadhu. Oru vishayam thondriyadhu, matra madhathil ippadi Indiya arasu seiyumaa enbadhu periya kelvikuri. Adhuvum satta redhiyaaga seiyumaa enbadhum theriyaadhu. Aanaal Indhu madha kolgaiyil thalai nuzhaipadhu niraiya dhadavai paarkirom! Secular aatchiyaa ilaiyaa? Adhuvum theriyalai?! Can’t expect much from government that’s all I can say. Sorry I am also a confused soul here!
This is another issue brewing in TN. Oru seiyalai seiyanum endraal one should look into pros and cons of that issue. I don’t know the full extent of this story but what I had watched and understood I will share here.
'Secular' has lost its original meaning. In the new age, it means for the so-called "secular parties" to hug and kiss the minorities - to keep hold of their vote banks in favor of them always while pushing rest of the nation to wit's end in the name equality for all. On the other hand, this gives enough opportunities for the Hindutva dharma-ists to claim the majority's votes in the name of saving the religion and people. We have tolerated both ends all these years but things are changing now. TN Jallikattu, Sterlite, 8way highway construction and the current Sabarimala protests... Nature of which is debatable anytime but it's also appreciable to see people marching on for what they think is their right or an unfair treatment by the govt or the law. And, that gives me hope. ha ha freeya vidunga, let's move on!
